The Beach Preservation Act (7 Del.C. Chapter 68) defines the beach as the area from the Delaware/Maryland line at Fenwick Island to the Old Marina Canal north of Pickering Beach, from the seaward edge of the beach to the landward edge of the 3rd buildable lot from the mean high water line. The Act defines the Regulated Area as the specific area within the defined beach that the Department is directed to regulate construction to preserve dunes and to reduce property damage.

Chapter 68) to enhance, preserve, and protect Delaware’s public and private beaches as valuable natural resources that provide recreational opportunities, wildlife habitat, and protection from coastal flooding and erosion. The Act established a regulatory framework for activities within designated beach areas to support the coastline's long-term sustainability. The DNREC Beach Preservation Regulated Area dataset depicts the geographic area in a GIS format where locations may be subject to permitting requirements and development restrictions. This dataset is intended for use by property owners, residents, developers, consultants, local governments, and state agencies to better understand the extent of the Beach Preservation Regulated Area. The dataset is provided for informational and planning purposes and should be used in conjunction with applicable statutes, regulations, and DNREC guidance.</SPAN></SPAN></P></DIV></DIV></DIV>
